General Terms and Conditions (as per section I, Title 3, part 3, od d.lgs 206/2005 and subsequent modifications and integrations)

These general terms and conditions of sale aplly to the sale of products through the website www.winecru.it 
The seller of the products and the owner of the website is "Winecru di Marco Paoletti", with registred office in Via dei Bonaccorsi 32 – 63100 Ascoli Piceno Italy, and vat identification number 02332850441. If you have any addiotional questions or further clarification, contact us by email (info@winecru.it) or by postal mail at our address listed above.

1. Purchase Order

In accordance with Legislative Decree of 9 April 2003, no. 70, regarding e-commerce, users wishing to purchase products must manifest this desire through a request made directly on the Website where, following the procedures described in the same Website, he/her will submit the purchase order and make the payment. Once the purchase order has been received, “Winecru di Marco Paoletti” shall send a confirmation email to the user, at the indicated email address. When the purchase order has been confirmed, the customer can check the details at any time by logging into his/her account.

2. Shipping Costs & Prices

The product prices are those displayed on the site at the time of issuance of the order by the user and are expressed in Euros (€). The product prices that appear on the website, if not otherwise specified, are understood as including VAT. The shipping costs and any other possible added cost, including VAT and expressed in Euros (€), shall be highlighted and separately indicated in the form before the user confirms the order. Winecru di Marco Paoletti reserves the right to change its prices at any time, but the products will be billed based on the fees in effect at the time of recording the orders. The products shall continue to be owned by Winecru di Marco Paoletti until the user pays the purchase price, shipping costs and any other possible added cost.

3. Returns

A) The customer has the right to terminate the purchase contract without incurring any penalty and without giving any reason, except in those cases referred to in paragraph IV below. In order to exercise this right, the Customer shall send a notice to "Winecru di Marco Paoletti" within 14 days from the date of receipt of the Products by registered letter with return receipt requested, to:

Upon receipt of the notice Winecru’s Customer Service shall open a file for the management of the returned Products and communicate to the Customer the instructions relevant to the return of the Products, which shall take place through the courier indicated by Winecru di Marco Paoletti itself.

The right of cancellation is subject to the following conditions:

I. The right applies to a Product purchased in its entirety; therefore, if the Product is composed of multiple components or parts the cancellation may not be exercised only on a part of the purchased Product.

II. In case of exercise of the right of cancellation, Winecru di Marco Paoletti shall refund the Customer the full amount of the returned Products, including shipping expenses, if any, within 14 days from the date in which the notice of cancellation was received, without prejudice to the right of Winecru di Marco Paoletti to suspend the payment of the reimbursement until the actual receipt of the Products. The reimbursement shall be carried out using the same payment method used by the Customer, unless he/she has specifically requested a different method. For money transfer or cash on delivery payments, Customers are bound to provide the banking information where they want their claim to be reimbursed (accounts holder, Bank name and address and IBAN)..

III. In order to guarantee the free return of Products pursuant to article 8 below, the Products shall be returned in the same box in which they were received

IV. In addition to the cases indicated in Article 1 above (customer not consumer and/or requiring the invoice), the right of cancellation is excluded in the following cases, pursuant to art. 59 of Legislative Decree no. 21/2014:

 orders of tailored or clearly personalized Products;
 orders of Products which are likely to deteriorate or expire rapidly;
• 
orders of sealed Products which are not suitable to be returned for hygienic reasons or connected to the protection of health or that were opened after the delivery.

With reference to the above cases where the cancellation right is excluded, the Customer is aware and agrees that among the Products that “are likely to deteriorate or expire rapidly” are included both all food Products (including wines, spirits and beverages) and cosmetics, because the features and qualities of these types of Products are subject to change even as a result of improper storage. Therefore, for reasons of hygiene and for the protection of Customers, the right of withdrawal applies only to Products purchased on the Website that may be returned to Winecru di Marco Paoletti and remarketed without danger to the health of the consumers (e.g. books, gadgets, kitchen utensils, etc.).

B) In accordance with article 14 of the Regulation 524/2013 we inform the user that in case of dispute he may file a complaint through the European ODR platform reachable by clicking on the following link http://ec.europa.eu/consumers/odr/ (the platform has been operational since 15 February 2016). The ODR platform is a point of entry for users seeking an out-of-court resolution of the disputes arising from online sales contracts or online services. To this end, we inform that the email address of www.winecru.it is info@winecru.it

4. Availability of products and services

The products offered on the site are limited in number. For this reason, it may happen, also due to the possibility that several users purchase the same product at the same time, that the product ordered is no longer available after the transmission of the purchase request. In case of lack of availability, total or partial, of the product or service on receipt of the order, the user shall be informed by email with the offer of:

• delivery of a partial order, with reimbursement of the missing product
• 
replacement of the missing product with a similar or better one
• 
cancellation of the order upon total reimbursement

When the user chooses to be refunded, Winecru di Marco Paoletti shall provide for reimbursement within 15 days from the request. The amount refunded shall be equal to the amount paid, including the shipping costs. Any delays in the credit may depend on the bank, the type of credit card or the payment solution used. In case of impossibility of re-crediting the amount to the credit card or the payment method adopted by the customer, the reimbursement shall take place by bank transfer, upon communication by the user of the relative coordinates and IBAN code. Neither party shall be liable for the failure of the order in case of force majeure, strike, natural calamities, terrorist attack, war, or problems of the suppliers, shipping or production, measures taken by the public authorities, or similar. In the cases listed above, both parties have the right to a reasonable additional period to absolve their obligations. However, for periods that exceed 60 days, the customer may cancel the order by written communication to the supplier.

5. Delivery

Deliveries shall be made to the territories listed on the website www.winecru.it, in the Shopping Cart section. The Estimated Delivery Date will be indicated during the purchasing process, before its completion. These shall also be indicated in the website, in the Shipping section. The delivery of the purchased products can take place, at the choice of the user:

• at the postal address indicated by the user as residence;
• at the alternative postal address requested in the order form

6. Shipping

The delivery is made when all the items purchased are available.The cost to the purchaser is calculated automatically on our e-commerce system according to the destination and weight of the merchandise. On delivery of the products to the shipper, an e-mail shall be sent to the user to confirm delivery, indicating the tracking number through which the delivery status may be verified. Each delivery is considered completed from the time the shipper makes the products available to the user, resulting from the system used by the shipper to trace the shipments.

The credit card details are input directly on the page of the partner bank of “Winecru di Marco Paoletti”, and they are transmitted to the bank’s server by using 128-bit encryption, according to the SSL Standard (Secure Socket Layer), one of the most advanced and effective protection systems currently available. For greater safety, only the partner bank has access to the information about the credit card used to make the payment, while “Winecru di Marco Paoletti” has no possibility of knowing or memorizing them. Each customer guarantees that he is enabled to use his credit card or PayPal account to pay the purchase order, and also that this payment methods permits access to sufficient funds to cover all the costs regarding the purchases of products through the website.

8. Protection of Personal Data

Winecru di Marco Paoletti guarantees to the user that personal data acquired in relation to the sale will always be processes in a lawfully and correctly way, in total compliance with the provisions of Legislative Decree of June 30, 2003, no. 196. For any further information about the personal data processing please read the section "Privacy Policy" and the information about the data processing provided to the user by Winecru di Marco Paoletti, pursuant to art. 13 of Legislative Decree no. 196/2003, at his/her registration to the website. The user ensures personal information provided during the registration procedure is true, accurate and up to date. The user accepts to hold Winecru di Marco Paoletti harmless from any compensation of obligation and/or penalty deriving from and/or in any moment linked to the break by the user of rules about registration to the Site.

9. Effect and modification of the General Conditions of Sale

These general terms of sale apply to purchases made directly from the website and may be modified at any time. Any changes and/or new conditions shall be effective from the date of their publication in the website, in Conditions of Sale. The applicable Terms and Conditions are those in force on the date of submission of the purchase order.The Terms and Conditions of Sale do not regulate the supply of services or the sale of products performed by anyone other than "Winecru di Marco Paoletti", which may be present on the website by links, banners or other hypertext links. Winecru di Marco Paoletti assumes no liability or responsibility for any error or omission in the content of these external websites.
